Definition of Abuse
Domestic violence is not limited to physical harm. Under Section 4, the law explicitly includes psychological abuse, harassment, stalking, and "behaving in an offensive manner" toward family members.
Mandatory Police Duty
The law mandates that Police must investigate any complaint of domestic violence. They have the authority to enter premises and seize weapons to ensure immediate safety.
Protection Orders
Courts can issue orders requiring a defendant to maintain "good behaviour." This can include Exclusive Occupation Orders, forcing an abuser to leave the family home.
⚠️ Criminal Consequences
A breach of a Protection Order is a serious criminal offence. Under the Act, any person who fails to comply with the conditions of an order faces imprisonment for up to 2 years or a significant fine.
